PRIVACY POLICY

This Privacy Policy (“Privacy Policy”) governs the manner in which International Cruise & Excursion Gallery, Inc. (ICE) ("we" "us" or "our"), the operator of this website ("Site"), collects, uses, maintains and discloses information collected from you though the use of the Site in the provision of services to Diamond Resorts International Club, Inc. (“Diamond”), whose content and brand are featured on the Site. This Privacy Policy applies to the Site and the products and services offered by us in connection with the content provided on the Site (“Services”).

We implemented this Privacy Policy so that you better understand:

  • What information is collected by us;
  • How the information will be used;
  • With whom the information will be shared (if anyone);
  • How to opt out of e-mail updates;
  • How to access your personal information (including how to update or correct inaccuracies);
  • What safeguards are in place to protect your information; and
  • Other information about your privacy.

1. Information We Collect

  • Registration information: In order to use the Services, you may be asked to provide us your name, address, telephone number, membership number and e-mail address.  In order to book a vacation you may also be asked to provide credit card payment information.
  • Vacation preferences: You may be asked questions about your vacation preferences and types of vacation activities that interest you.
  • Voluntary communications: We may collect your personal information or data if you voluntarily submit it to us. For example, if your personal information is included in your communications to us, including via email or other communications channels. When you make comments or offer a testimonial: If you make comments on the Site or agree to provide a customer testimonial or review, or submit photographs, this information will be included in public areas of the Site and any information you provide in these areas might be read, collected, and used by others who access them. If you provide a testimonial, your name will be posted along with the testimonial.

Information we collect passively:

  • IP Address: In addition to information you provide to us, when you use the Site or the Services we automatically record information about your IP address, the page that directed you to the Site, and the browser type used while accessing the Site. A server log stores the information collected so it can be analyzed. Your IP address is a number that lets computers connected to the Internet know where to send you data, such as web pages you view.
  • Cookies: Cookies are a browser feature that allows us to assign each visitor a unique, random number, like a user ID, which resides on your computer. We also use cookies to create a better user experience in order to: help remember and process the items in the shopping cart; understand and save your preferences for future visits; and compile aggregate data about website traffic and website interactions in order to offer better website experiences and tools in the future. We may also use trusted third-party services that track this information on our behalf. Although you may disable cookies in your browser and still access and use the Site, disabling cookies may prevent you from taking advantage of certain features on the Site.  See also Section 6 below for specific information on how to manage cookies.
  • Some of the information passively collected may be combined with your personally identifiable information to further enhance your experience while on the Site.
  • Analytics: We use third party analytics providers and products, such as Google Analytics, to obtain, compile and analyze information about how users are using and interacting with the Site. In order to collect this information, such providers may set cookies on your browser or mobile device, or read cookies that are already there. Google Analytics may also receive information about you from apps you have downloaded, that partner with Google. We do not combine the information collected through the use of Google Analytics with personally identifiable information.

Visitors can control the information provided to Google and opt out of certain ads provided by Google by using of the of the methods set forth in  http://www.google.com/policies/privacy/partners/  or use the Google Analytics opt out browser add-on at  http://tools.google.com/dlpage/gaoptout . Visitors can also opt-out of GA for Display Advertising and customize Google Display Network ads by changing the ad settings at the following link: http://www.google.com/policies/technologies/ads/.

2. How we use your Information

We may use the information we collect from you in the following ways:

  • To help diagnose problems servers and for system administration;
  • To personalize your user experience and to allow us deliver the type of content and product offerings in which you are most interested;
  • To improve the Site in order to better serve you;
  • To better serve you in responding to your customer service requests;
  • To quickly process your transactions;
  • To ask for ratings and reviews of services or products;
  • To follow up with you after correspondence (live chat, email or phone inquiries);
  • To develop promotions and product improvements; and
  • To provide you with updates about discounted availability, special offers, new services and products which may be of interest to you and other noteworthy news items.  This information may be provided by letter, e-mail, telephone or any other reasonable means of communication.

3. How we share your information

  • Because we are offering the Services on behalf of Diamond all information that we collect may be made available to Diamond and its affiliates and subsidiaries under the terms of this Privacy Policy. Diamond affiliates and subsidiaries include companies that are subsidiaries and affiliates of Diamond Resorts Corporation and Diamond Resorts (Europe) Limited.
  • Service Providers: We share some of your information with service providers that need access to your information to provide operational or other support services including, but not limited to, credit card processors, travel suppliers, booking agents, website hosting, email service providers, and website analytics providers.

We require all service providers to safeguard your information in strict compliance with this policy and in accordance with industry security standards. Service providers are prohibited from using your personal information for their own, or any others, marketing, sales, or promotional purposes.

  • Customs and Immigration authorities: All travel providers are required by law introduced in the U.S. and other countries to give cross border control agencies access to customer data. Accordingly, any information held about you and your travel arrangements may be disclosed to the customs and immigration authorities of any country in your itinerary.
  • Public areas of the Site: Any comments, photographs, or information you provide on the public areas on the Site and can be seen by all Site visitors. We disclaim any liability and otherwise hold Us harmless for the comments, photographs, or information you provide in public areas of the site.
  • As permitted by law: We may disclose your personal information to law enforcement and other governmental authorities insofar as it is required by law or is strictly necessary for the prevention, detection or prosecution of criminal acts and fraud. We may also disclose member information, if, in good faith, we believe that disclosure is necessary or advisable including, without limitation, to protect our rights or properties, enforce our Terms of Use or this Privacy Policy, or in order to identify, contact or bring legal action against someone who may be causing interference with our rights or properties, whether intentionally or otherwise, or when anyone else could be harmed by such activities.
  •  Merger, Transactions, or Bankruptcy:  In the event that we undergo a corporate restructuring,  enters into a merger, acquisition, sale or other transaction pursuant to which, we or any portion of its assets or stock is acquired by or assigned to a third party, or if we are involved in a bankruptcy, dissolution, reorganization, liquidation, similar transaction or proceedings, your personal information, including the questions and answers of your survey may be among the items sold or otherwise transferred and may be shared with third parties, including buyers, service providers or law enforcement officials.

4. Cross Border Data Transfers

We transfer, process and store information about you on servers located in the United States. Therefore, your information may be transferred to, stored, or processed in the United States whose data protection, privacy and other laws may not provide the same level of protection as those in your country of residence. For example, government entities in the United States and other countries may have certain rights to access your personal information. 

Information we collect from the European Union (EU) member states and Switzerland is transferred and processed using standard contractual clauses.  Diamond complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework ("Privacy Shield") regarding the processing of all personal information it receives from EU member states and Switzerland in reliance on the Privacy Shield. To the extent that PII is transferred to the United States from countries other than European Union member countries and Switzerland, Diamond employs similar safeguards, selecting third party vendors carefully, ensuring PII will be used and disclosed only as set out in this privacy policy and that it be protected by appropriate security safeguards.

By using the Site or the Services you understand and consent to the collection, storage, processing, and transfer of your information to our facilities in the United States to those third parties with whom we share it as described in this policy. You may revoke your consent at any time. Please note that if you revoke your consent to the transfer of the information to the United States, we may no longer be able to provide you our Services.

5. How we retain and protect your information

We will retain your personal information for a period that is reasonably necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

We implement reasonable security measures to prevent unauthorized processing of your personal information. All information you provide to us is transmitted using SSL (Secure Socket Layer) encryption. SSL is a proven coding system that lets your browser automatically encrypt, or scramble, data before you send it to us. All of your credit card information is processed by a PCI DSS certified payment processor. However, regardless of the security measures we implement, transmission over the internet is not completely secure nor is any type of electronic storage and there is always a risk that your information may be access or used by authorized third parties.

6. Choices with respect to your Information

  •  Accessing and amending information: You can always request to review and to amend the customer information we store about you by emailing us at iceresortservices@iceenterprise.com.  
  • Deleting information: If you do not want to use our Services anymore, you can ask us to block your personal information from being used again.  Requests to update, block or remove your personal information can be made by e-mailing us at iceresortservices@iceenterprise.com. We may need to retain certain information, for example for legal or administrative purposes, such as recording keeping, to process claims or detect fraudulent activity.

Please keep in mind that the deletion by our third party providers may not be immediate and that the deleted information may persist in backup copies for up to 12 months or as required by legal and/or technical requirements that apply to such third parties. Your information may also be held by any third party with whom this information had previously been shared.

  • Communications: If you wish to stop receiving email communications from us, you may click on the “unsubscribe” link in them. This will not stop any service communications from us.
  • Analytics:  You can control the information provided to Google and opt out of certain ads provided by Google by using one the of the methods set forth in  http://www.google.com/policies/privacy/partners/ or use the Google Analytics opt out browser add-on at  http://tools.google.com/dlpage/gaoptout?hl=en. 
  •  Cookies and other technologies: Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Site may not function properly if the ability to accept cookies is disabled. Turning off the browser's cookies will prevent web beacons from tracking your specific activity. The web beacon may still record an anonymous visit from your IP address, but unique information will not be recorded. If you do not want to receive tracking pixels, you will need to disable HTML images in your email client, and that may affect your ability to view images in other emails that you receive.   • These opt-out mechanisms rely on cookies to remember your choices with respect to ad-serving on websites. If you delete your cookies, use another computer or device, or change browsers, you will need to repeat this process. In addition, opting out of interest-based ads will not opt you out of all ads, but rather only those ads that are personalized to your interests based on activities observed on the Site and/or web sites or mobile apps not owned and operated by us or Diamond.

7. Do Not Track

Some web browsers may let you enable a "Do Not Track" feature that sends signals to the website you visit, indicating you do not want your online activities to be tracked or engage in other types of data collection. These are segments of computer code that communicate with a website similarly to cookies. However, this is different than blocking or deleting cookies, as browsers with a “Do Not Track” feature enabled may still accept cookies. This Site does not currently honor "Do Not Track" requests. 8. Children

You must be at least 21 years old in order to submit any information, or reserve a stay.

We do not intentionally or knowingly collect personally identifiable information from children under the age of 13. If you are under 13 years of age, please do not send any information about yourself, including your name, address or e-mail address. If we discover that we have collected any personal information from a child under the age of 13, we will remove that information from our database as soon as possible.

9. Changes to this Privacy Policy and acceptance of these terms

If we update this Privacy Policy, we will notify you by posting the revised Privacy Policy on the Site, and for certain revisions that materially expand the ways in which we use or share the information previously collected from you either display an alert next to the Privacy Policy or otherwise on the Site in advance of and/or concurrently with the changes taking effect, or directly communicate with you in advance of the changes. Your continued use of the Site, our products and services after the changes have been made will constitute your acceptance of the changes. Please do make sure you read any such notice carefully. If you do not wish to continue using the Site, our products or services under the new version of the Policy, please cease using them and contact us with your concerns, otherwise we will interpret your continued use as acceptance of the changes.
