What is the Best Available Price (BAP) Guarantee?

We will guarantee that the combined available price of our posted lowest market price less any loyalty currency (where applicable) will be better than the lowest publicly available market price of any other merchandise seller (“Qualified Seller”). If our combined available price is not better, we will match the Qualified Seller’s lowest market price at the time of purchase or within 24 hours of purchase. 

Reporting a BAP claim.

You must contact us within 24 hours at 1.877.374.2582 after your purchase or booking with us to make a claim under the BAP. The lower price you reference must be available for purchase at the time you contact us, as determined solely by OVR customer service representatives.  All qualifying purchases must be made using a valid credit card.
 

What is considered a lower price?

To qualify as a “lower price” for purposes of making a claim under the BAP, the lower price must apply to an identical purchase (excluding shipping costs) as determined in our sole discretion. “Identical” means that all purchase details must exactly match the details of the purchase made through; for example the specific supplier, the applicable refund policy, and other purchase details including cancellation policies. 
 

BAP Terms & Conditions

1. The BAP is valid for up to 24 hours after purchase. You must report that you have found a lower price than our Available Price within 24 hours of purchase and must show verifiable proof of public availability of the lower price. If you find a price lower than our Available Price by greater than one US dollar and your request is approved, we will match that lower price, and apply the applicable points value redemption as per the appropriate benefits rules that pertain to your membership. To make a BAP claim you must call Diamond Resorts Customer Service at 1.877.374.2582 and verify the lower price by providing proof such as advertisements or website addresses as directed. Diamond Resorts and its affiliates reserve the right to determine the validity and authenticity of the proof provided.
2. The BAP must be an equivalent Comparison. The BAP is available only against prices advertised and offered to the general public on English language internet websites. It is not valid against prices requiring a call-back, or on pricing offered on e-mails you received that are not also advertised on public access websites, or otherwise available to the general public. You must meet all requirements imposed to obtain the lower price (if any) including, without limitation, residency, regional and age-related requirements. If the applicable website or mobile application requires an individual to be a resident of a certain jurisdiction in order to book prices on such website or mobile application, the BAP will apply to any prices found on such website or mobile application only if the purchaser is a resident of that jurisdiction. The lower price must be quoted and booked in U.S. dollars (without reference to currency converters). Also not valid on prepaid prices that involve voucher, certificate, or on prices available on auction websites, or on discount prices offered to members who must meet specific criteria.
3. Lower prices do not include errors or mistakes. The BAP does not include prices offered on other membership program websites, unpublished or negotiated prices including but not limited to, corporate discounts or prices, military prices, rewards program, limited quantity sales, incentive, prices obtained via auction or similar process, or prices available only by using a coupon or other promotion not offered to the general public or a pay in advance coupon promotion. 
4. Verification. All requests, including receipts, are subject to our verification. We will not accept screenshots or other purported evidence of a lower price that cannot be independently confirmed by our customer service representatives. Nor will We verify any request that we believe, in our sole discretion, is the result of a printing or other error or is made fraudulently or in bad faith. 
5. Changes. Diamond Resorts and its affiliates reserve the right in their sole discretion to modify or discontinue the BAP or to restrict its availability to any person, at any time, for any or no reason, and without prior notice or liability to you. The terms that are in effect at the time of your claim will determine your eligibility under the BAP. The failure by Diamond Resorts or its affiliates to enforce any provision of these Terms & Conditions shall not constitute a waiver of that provision. 
6. Abuse of Best Price Guarantee. At any time, Diamond Resorts and its affiliates reserve the right to revoke any and all benefits of a Guarantee (including the right to cancel a previously awarded claim) if it is found that You have attempted to or has violated or circumvented the BAP Terms and Conditions. Resale of Products eligible for the BAP is strictly prohibited. Diamond Resorts and its affiliates reserve the right to reject future BAP Claims from You or any other Member who participated in such actions.

7. Limit. BAP Claims shall be limited to three (3) Claims by you per calendar month, regardless of the number of accounts used by you. Any modifications, changes or cancellations made to an existing purchase or booking that has an associated BAP Claim will result in voiding the Claim. You will be responsible for any applicable cancellation fees. Diamond Resorts and its affiliates reserve the right to void any Claim that is found to be in excess of these limits, issued in error, or where you are found to be ineligible.

8. Additional Terms and Conditions. For any stand-alone product purchase, the comparison must be to the same product purchased stand-alone through the other website (i.e., not part of a set or multiple product / bulk purchase). Except as otherwise noted below, the BAP only applies to the base price, and not taxes, service fees and other charges. 
   
   For merchandise, the best available price comparison does not include shipping costs.
